Kitchen Rental Terms
Please read these before you book or use the kitchen — they apply to everyone working in the space. By booking, you confirm that you have read and agree to them. Your specific dates, times and amount are set out in your booking.
1. Scope of Use
You may use the shared kitchen facilities at Ngara Food Projects (the "Facilities") for commercial food preparation (the "Permitted Use"), subject to these terms. Any use beyond the Permitted Use requires our prior written consent.
2. Rate and Payment
- The Facilities are available for rental between 8:00 AM and 11:00 PM. The standard rate is KES 3,000 per hour, with a minimum booking of 3 hours.
- Full payment is required before you are granted access. A booking is confirmed once payment has been received.
- The booked hours are payable in full regardless of your actual arrival or departure time.
- Where you exceed the booked end time, each additional hour (or part thereof) is charged at the applicable hourly rate and invoiced separately.
- For each booking you (or your authorised representative) sign the check-in and check-out sheets, which are used to confirm any additional time used beyond the booked period.
- A cleaning attendant supports you during the booked period — clearing your workspace, dishwashing, general cleaning on request, and returning your items to designated shelves. You remain responsible for leaving the Facilities, equipment and work areas clean, orderly and safe at the end of each booking.
- Any additional charges arising from damage, excess use or additional services are invoiced separately and payable within 7 days of invoice.
3. Booking and Cancellations
- The dates and times in your booking constitute your booking under these terms.
- Cancellations made with less than 12 hours' notice are charged at the full applicable rate for the relevant booking date.
- We may cancel or reschedule bookings in cases of emergency, facility maintenance or force majeure, with as much prior notice as reasonably practicable.
4. Access, Onboarding and Time Logging
- Access is granted only after completion of a walkthrough and onboarding session, once the agreement has been accepted and full payment received.
- Before access for any session, you (or your authorised representative) sign a check-in sheet recording the date and time of arrival; on leaving, a check-out sheet recording departure. Our staff do not sign on your behalf.
- The signed check-in and check-out times are the definitive record of session duration and the basis for any additional billing under section 2.
5. Your Responsibilities
- Comply with all kitchen standard operating procedures, hygiene protocols and fire safety regulations at all times.
- Leave the Facilities clean and orderly after each session.
- Immediately report any damage, equipment malfunction or safety concern to us.
- Do not permit or facilitate access by any third party without our prior written approval.
- Hold and maintain all food business licences, health permits and other certifications required by law for your operations.
6. Liability and Indemnification
- We are not liable for any loss, injury or damage — whether direct, indirect or consequential — arising from your activities within or in connection with the Facilities.
- You agree to indemnify, defend and hold us, our officers, employees and agents harmless from any claims, liabilities, losses, damages or expenses (including reasonable legal fees) arising out of or relating to your use of the Facilities or any breach of these terms.
- You are solely responsible for securing adequate insurance for your operations, including public liability and product liability insurance.
7. Termination
- We may terminate immediately, without prior notice, in the event of a material breach of these terms.
- On termination, you shall immediately vacate the Facilities and remove all personal property.
- Either party may terminate with at least 24 hours' written notice, provided any cancellation charges, outstanding payments or amounts already due remain payable.
8. Governing Law and Dispute Resolution
These terms are governed by the laws of the Republic of Kenya. Any dispute is first addressed through good-faith negotiation; if unresolved within 14 days of written notice, either party may refer it to mediation or, failing resolution, to the courts of competent jurisdiction in Kenya.
9. Entire Agreement and Amendments
These terms, together with your booking, constitute the entire agreement between the parties on this subject and supersede all prior understandings. No amendment is binding unless made in writing and duly agreed by both parties.
10. Severability
If any provision is found invalid, unlawful or unenforceable, it is severed and the remaining provisions continue in full force and effect.
